Terms and Conditions
The Following provisions are a summary of Muthu-IT’s full Terms and Conditions of sale which are available on request. By entering into a contract with Muthu-IT you shall be deemed to have accepted the full Terms and Conditions unless notice of cancellation is given within 10 working days. Services delivered pursuant to the contract remain the property of Muthu-IT until full payment has been received. Risk in the service shall pass on delivery.
In the event of payment being delayed by the customer in excess of the agreed payment terms of contract Muthu-IT shall have the right to charge interest at the annual rate of 5% above the prevailing bank of England base rate on the outstanding sum until the funds are received in full.
Time of delivery as set out in the contract shall be of essence but Muthu-IT shall not be liable for loss suffered by the customer arising out of delay in delivery of the service.
With some types of the service third party installation of underground or long-distance circuitry and equipment is required, in such cases the term of the contract shall commence from the date that the last circuit and equipment is commissioned for customer use.
Provision of the service can be terminated at any time after the minimum term, but depending on the service in question any such termination will require the customer to give the required period of notice stipulated in the Terms & Conditions and make full payment for the unexpired portion of any minimum term contract period or the subsequent renewal. Contracts for certain types of service may be automatically renewed unless terminated by the customer.
Unless specifically agreed between the parties no express or implied warranties are given by Muthu-IT with respect to the service as to fitness for any particular purpose.
Claims made for damage, shortage or lack of quality, must be made in writing within twenty-one days of delivery of the service. Claims made after this period will only be entertained at the sole discretion of Muthu-IT
To the extent permissible at law, Muthu-IT shall not be liable for any consequential or other loss suffered by the customer arising out of defect in the service.
The customer and Muthu-IT shall ensure full compliance with the GDPR. The customer as a data controller shall ensure that it has all necessary consents or valid legal grounds for processing that it requires MuthuIT to perform as a data processor.
Muthu-IT shall have the right to terminate the contract should the customer default on any of its obligations.
